The Centre for Intellectual Property Rights, Institute of Law, Nirma University organised IP Conclave 2.0 on 22-November-2024. Mr Pranay Bali (Partner, ALG India Law Offices LLP), Mr Abhishek Gurbani (Partner, Saikrishna & Associates), Ms Ankita Sabharwal (Senior Associate, Chadha & Chadha), and Ms Sunaina Brahma (Senior Associate, Khaitan & Co.) graced the event as guest speakers.
Mr Bali acquainted the students with the effective enforcement strategies for trademark protection, conducting an investigation through various means and sources, analysing the parties’ rights, filing a lawsuit for infringement, evaluating and drawing up the enforcement strategy. Mr. Gurbani spoke on the topic of legal challenges of content creation from an IP point of view. In the era where the content creation is booming and an individual’s day to day basic decision makings are being influenced by these content creators, it becomes necessary for these content creators to protect their content. Mr Gurbani highlighted the importance of compliance with trademark and copyright laws for the content creators and how to avoid successful infringement claims against them. He shed light on the concept of fair use or fair dealing provided under section 52 of The Copyright Act, 1957 and how it can come to the rescue of the content creators.
Ms Sabharwal spoke on the topic of ethical and legal boundaries in data processing done by the businesses. She called attention to the manner in which the digital personal data of the “consumers” of the apps are being analysed and used and how it becomes imperative for the individuals to be aware of the risk involved in the breach of their piracy. With the enactment of Digital Personal Data Protection Act, 2023, she explained how the businesses will have to comply with the new act, what are the responsibilities of data fiduciary and how it will ensure the privacy of the people by bringing the option of editing the personal data, restricting the use of personal data and the right to erasure from a platform. Ms Brahma spoke on the aspect of comparative advertising and considerations and explained the concept with various illustrations of comparative advertisements and the ensuing case laws and how many of them were taken down on the ground of disparagement. Dr Gunjan Arora Assistant Professor and Associate Head, Centre for Intellectual Property Rights at the Institute coordinated the event.
