Constitutional Law Conclave

The Institute of Law, Nirma University organised a Constitutional Law Conclave at the Institute from February 19 to 22, 2024. Padma Shri Prof. (Dr.) Upendra Baxi  (Former Vice Chancellor, Delhi University and South Gujarat University, and Emeritus Professor of Law, University of Warwick and Delhi),  Dr. Ekramal Haque (Professor, University of Dhaka, Bangladesh),  Dr. Stephen Barnes (Associate Dean, Penn State Law, USA), and Dr. Peter Bacic (University of Spilit) were the esteemed speakers at the event.

Prof. (Dr.) Upendra Baxi shared his views on the topic of Basic Structure Doctrine, delving deep into sovereignty, jurisprudential aspects, evolution of basic structure starting from the Kesavananda Bharti case to its modern implications and commented on the working of three pillars of Indian democracy. He shared the views of several thinkers and jurists including Roscoe Pound, legal practitioners, and the Supreme Court judges. The lecture explored the vast domains of the basic structure doctrine and its contemporary implications.

At the Panel Discussion, Prof Ekramul Haque, Dr. Stephen Barnes, and Dr Peter Bacic the central idea of discussion was the scope and extent of judicial review in different jurisdictions. The discussion revolved around the study of review on grounds of Policy decisions, Legislative proceedings, and Amendment procedures. The session highlighted the rules and norms of judicial review prevalent in Bangladesh, the USA, and the European Nations.

Prof. Ekramul Haque also spoke on the topic “Salient features of Bangladesh Constitution.” The session was focussed on the legality of ideas, doctrines, and provisions that got recognition and protection in the Constitution of Bangladesh.

Prof. (Dr.) Madhuri Parikh – Dean and Director (I/c), ILNU observed that the Conclave is an attempt to give contemporary, academic, and practical insight into the existing Constitutional Framework of the country. The domain of Constitutional Law is vibrant, organic, and dynamic and therefore it is important to keep track of updated and ever-developing jurisprudence in this field. It is in this context that the Conclave is designed to cater to this requirement for students. Prof. Abhas Srivastava was the coordinator of the event.
