Institute of Law, Nirma University conducted an online expert lecture on Constituent Assembly Debates by Dr. Satish Kumar Jha, Professor of Political Science at Aryabhatta College, Delhi University on 16th and 23rd April, 2025. The lecture focused on the political and philosophical underpinnings and discourse that happened during the framing of the constitution. Dr. Jha emphasised on the distinction between revolutionary and evolutionary constitutionalism, arguing that the Indian Constitution leaned more towards the latter. He questioned the absence of grassroot voices, particularly that of Gandhi, and critiqued the phrase ‘We the People’ as lacking real substance in the Indian context. The lecture further highlighted the tension between the Indian elite and the masses and how questions of caste, language and religion were central challenges to national unity. All of these questions were particularly resolved by the Assembly Debates by reaching a compromise. He also explored the shift in minority representation post 1949 – noting the withdrawal of reservations for religious minorities. The lecture also placed importance on the role of Dr. Ambedkar and the significance of Universal Adult Franchise. Dr. Jha critiqued the liberal and Marxist interpretations of the Constitution, urging a more nuanced understanding. Overall, the lecture served as a continuing reminder of the intricacies of how the Constitution has shaped our present. It encouraged students to view the Constitution as a complex and evolving political document rather than a static legal text. This program was coordinated by Prof. Nitesh Chaudhary.
