The Institute of Law, Nirma University organized the inaugural session of the Constitutional Law Conclave at the Institute on Feb 19, 2024. The session on ‘Modern Contours of Basic Structure Doctrine’ was delivered by Padma Shri Prof. (Dr.) Upendra Baxi.
Prof. (Dr.) Upendra Baxi delved into the ideas related to the Doctrine of Basic Structure including sovereignty, jurisprudential aspect, evolution of basic structure starting from the Kesavananda Bharti case to its modern implications and commented on the working of three pillars of the Indian democracy. He shared the views of several thinkers and jurists including Roscoe Pound, legal practitioners and the Supreme Court judges. He also discussed the scope of basic structure doctrine and its contemporary implications.
Earlier, Prof. (Dr.) Madhuri Parikh, Dean and Director (I/c), Institute of Law delivered the welcome address. She stated that this conclave is an attempt to give contemporary, academic and practical insight into the existing Constitutional Framework of the country. As the domain of Constitutional Law is vibrant, organic and dynamic therefore it is important to keep a track of ever developing jurisprudence in this field.
Prof. Abhas Srivastava- Assistant Professor and Faculty co-ordinator conveyed that the conclave revolves around the central theme- 50 Years of Basic Structure Doctrine: Tracing the contribution of the Doctrine in the Development of India’s Constitutional Jurisprudence. The 4day conclave shall cover themes: Constitutional Amendments and Basic Structure: New Challenges, The Intersections of Basic Structure and Constitutionalism, Legislative Overruling and Basic Structure: Balancing the Dynamics, Limitations and Challenges to Basic Structure Doctrine and Contesting the Constitutional Finality of ideas protected by Basic Structure. Prof. Abhas Srivastava also delivered the vote of thanks at the event.
